Notice of Discipline
Mr. Kenneth Brubacher, COFS was disciplined on May 30, 2017. A PANEL OF THE DISCIPLINE COMMITTEE OF THE COLLEGE OF PEDORTHICS OF CANADA ORDERED AND DECLARED that Kenneth Brubacher did commit conduct contrary to the Code of Ethics and Standards of Practice of The College of Pedorthics of Canada. Mr. Brubacher is hereby required to register for and complete the University of Western Ontario Pedorthics Course (PEDS 6021) by way of online enrollment and to be completed in accordance with the requirements of the said Pedorthics Course.
Notice of Discipline
The College of Pedorthics of Canada (the “College”) received a complaint that a clinic operating in the City of Ottawa was offering a substantial credit toward the purchase of footwear for each purchase of orthotics made by its patients (the “Discounted Footwear Program”). As a result of the complaint, the College launched an investigation.
During the course of its investigation, the College learned that the clinic in
question was in fact offering the Discounted Footwear Program to its patients. An employee of the clinic explained, during the investigation, that because a patient ordered orthotics, they would receive significant credits toward the purchase of footwear for each pair ordered (to a maximum of two pairs). An employee of the clinic also explained that a similar program was in effect should the patient purchase compression socks.
The College also discovered during the course of its investigation that Laura Mazier (“Mazier”), a member of the College and a contractor to the clinic, was aware of the Discounted Footwear Program, was aware that it was being offered to patients of the clinic, explained the Discounted Footwear Program to a patient, and was aware that the College would not approve of such a practice.
Following its investigation, the College notified Mazier that she appeared to be in breach of the Code of Ethics and Standards of Practice, in particular, professionalism, Section 8 of Standard 8.
On or about July 21, 2017, The College of Pedorthics of Canada issued a
Citation to Mazier pursuant to which it was alleged that she engaged in
conduct which having regard to all of the circumstances would reasonably be regarded by members as dishonourable or unprofessional, contrary to the Code of Ethics and Standards of Practice, in particular, professionalism, Section 8 of Standard 8, which provides that the pedorthist may not solicit clients or referring professionals with gratuitous offers. A Hearing before a Panel of the Discipline Committee of the College of Pedorthics of Canada to consider the charges contained in the Citation was scheduled to take place on May 1 and May 2, 2018
Ms. Mazier has entered a plea of guilty to the charge of professional
In entering the plea of guilty, Mazier has admitted that given her contract work at the clinic, she was exposed to and participated in soliciting a client with
gratuitous offers contrary to the Code of Ethics and Standards of Practice, in particular, professionalism, Section 8 of Standard 8. In accepting the joint recommendation of counsel for Mazier and counsel for the College, the Panel of the Discipline Committee considered that a reprimand would be an appropriate penalty, having regard to the fact that Ms. Mazier has no prior discipline history with the College.
The Panel of the Discipline Committee accepted the joint recommendation of counsel for Mazier and counsel for the College and ordered that Mazier be reprimanded and that she pay a fine of $1,500.00.
